Please read these terms carefully before engaging Santi Counsel's services. By making an enquiry or entering into a service agreement, you confirm that you have read and accept the terms set out below.

SECTION 01

Definitions

Throughout these Terms & Conditions, the following terms carry the meanings set out below:

"Agreement"
The contract formed between you and Santi Counsel upon your acceptance of these Terms, together with any written service engagement letter or quotation.
"Service"
Any pension advisory or legal assistance service provided by Santi Counsel, as described in Section 3 below.
"User" / "Client"
Any individual or entity that accesses this website or engages Santi Counsel for services.
"We / Us / Our"
Santi Counsel, operating from 29 Thanon Ratchadamnoen, Mueang, Nakhon Si Thammarat 80000, Thailand.
"Content"
All text, documents, summaries, and materials produced by Santi Counsel in connection with your engagement.
"Website"
The website operated by Santi Counsel at https://santicounsel.club.

SECTION 02

Acceptance of Terms

By submitting an enquiry through our website, contacting us by telephone or email, or entering into a service agreement with Santi Counsel, you confirm that:

  • You are at least 18 years of age;
  • You have the legal capacity to enter into a binding agreement;
  • You have read, understood, and accepted these Terms & Conditions in full;
  • Where you are acting on behalf of a third party, you have the authority to bind them to these Terms.

If you do not accept these Terms, please refrain from using our services or this website.

SECTION 03

Service Description

Santi Counsel provides specialist advisory and legal assistance in connection with pension entitlements and related administrative matters in Thailand. Our principal services are:

1. Pension Position Review — ฿1,520

A careful review of your pension position accompanied by a plain-language written summary. Includes a private consultation. Delivery is typically within one to two weeks.

2. Records Collection and Liaison — ฿2,700

Patient collection of relevant documentation and liaison with the appropriate office on your behalf, with regular updates. Timelines are subject to third-party cooperation.

3. Appeal and Review Representation — ฿4,140

Full representation through an appeal or formal review of a pension decision. Includes document handling, case preparation, and ongoing support throughout the process.

Services are provided within Thailand. Availability may vary depending on case complexity and workload. We will notify you promptly of any material limitations applicable to your matter.

SECTION 04

Engagement Process

Engagement with Santi Counsel proceeds as follows:

  1. You submit an initial enquiry via our website, telephone, or email.
  2. We assess your matter and confirm whether we are able to assist.
  3. Where we can proceed, we will send you a written service confirmation setting out the scope, fee, and estimated timeframe.
  4. The engagement formally commences upon your written acceptance and, where applicable, payment of the agreed fee.
  5. We will keep you informed of progress at reasonable intervals throughout the engagement.

Santi Counsel reserves the right to decline any matter at its reasonable discretion, without obligation to provide detailed reasons.

SECTION 05

User Responsibilities

As a client, you agree to:

  • Provide complete, accurate, and truthful information relevant to your matter;
  • Supply documents and records in a timely manner when requested;
  • Notify us promptly of any changes to your circumstances that may affect the matter;
  • Communicate through designated channels and respond to our queries within a reasonable time;
  • Refrain from misrepresenting your identity, eligibility, or the nature of your pension matter;
  • Not use our services for any unlawful purpose.

We are not responsible for delays or adverse outcomes arising from inaccurate, incomplete, or late information provided by the client.

SECTION 06

Intellectual Property

All content appearing on this website — including text, layout, design, and materials — is the property of Santi Counsel or its licensors. No part of this website may be reproduced, distributed, or adapted without prior written consent.

Written summaries, case assessments, and other documents prepared by Santi Counsel for your matter are provided for your personal use in connection with that matter only. They may not be resold, published, or shared commercially without our written agreement.

You retain ownership of documents, records, and information you supply to us. By providing them, you grant us a limited licence to use them for the purpose of your engagement.

SECTION 07

Payment Terms

All fees are quoted and payable in Thai Baht (฿). Applicable fees are as follows:

  • Payment terms will be confirmed in your engagement letter. Fees are typically payable in advance of work commencing.
  • We accept bank transfer and other methods as notified to you at engagement.
  • Refunds, where applicable, are considered on a case-by-case basis according to work completed. If a matter cannot proceed for reasons within our control, fees paid will be returned in proportion to services not yet rendered.
  • Third-party costs (such as official filing fees, postage, or translation) are not included in the above fees and will be notified separately.

SECTION 08

Service-Specific Terms

8.1 Pension Position Review

The review is based on information and documents provided by the client. Our written summary reflects the position as assessed at the date of the review. We do not accept responsibility for changes in regulations or administrative interpretations that occur after delivery of the summary.

8.2 Records Collection and Liaison

Timelines depend on the cooperation and processing speeds of relevant third-party offices. We will keep you informed of progress but cannot bind third parties to any particular deadline. Delays caused by third-party offices do not entitle the client to a fee refund unless we have agreed otherwise in writing.

8.3 Appeal and Review Representation

Representation is conducted on the basis of the facts and documents available. Each case is assessed individually. We do not undertake that any particular outcome will be achieved. Our role is to present your position carefully and fully; the decision rests with the relevant authority.

SECTION 09

Disclaimers

Santi Counsel provides advisory and liaison services in good faith. However:

  • Services are provided as described and without warranty of any specific administrative outcome;
  • Information on this website is for general orientation only and does not constitute legal advice in any specific matter;
  • Decisions made by pension authorities or courts are beyond our control and cannot be assured in advance;
  • Third-party links or references on our website are provided for convenience only; we do not endorse or take responsibility for external content.

SECTION 10

Limitation of Liability

To the fullest extent permitted by Thai law:

  • Santi Counsel's aggregate liability in connection with any engagement shall not exceed the total fee paid by the client for the relevant service;
  • We exclude liability for indirect, consequential, or special losses, including loss of pension entitlement attributable to decisions made by a third-party authority;
  • We are not liable for losses arising from events beyond our reasonable control, including regulatory changes, system outages at government offices, or force majeure.

Nothing in these Terms excludes liability for fraud, wilful misconduct, or any other liability that cannot be limited by law.

SECTION 11

Confidentiality

We treat all client information with care. Documents, records, and personal details shared with us will be used solely for the purpose of providing the agreed services and will not be disclosed to third parties except:

  • Where required to complete the engagement (e.g., liaising with the relevant pension office on your behalf);
  • Where required by applicable Thai law or a lawful authority;
  • With your express written consent.

SECTION 12

Termination

Either party may terminate an engagement by giving written notice to the other party. On termination:

  • Santi Counsel will cease work on the matter and return originals of client-supplied documents;
  • Fees paid will be reviewed in proportion to work completed at the date of termination;
  • Clauses relating to confidentiality, intellectual property, limitation of liability, and dispute resolution shall survive termination.

We may terminate an engagement immediately in the event of material breach by the client, including the provision of false information or non-payment of agreed fees.

SECTION 13

Dispute Resolution

These Terms are governed by the laws of the Kingdom of Thailand. In the event of any dispute arising from or in connection with an engagement with Santi Counsel, the parties agree to:

  1. First attempt to resolve the matter informally by written notification to Santi Counsel at [email protected];
  2. Allow 30 days for good-faith discussion and resolution;
  3. If the matter cannot be resolved informally, submit to the jurisdiction of the competent courts in Nakhon Si Thammarat Province, Thailand.

The parties may by mutual written agreement choose to refer a dispute to mediation before initiating court proceedings.

SECTION 14

General Provisions

Entire Agreement

These Terms, together with any written engagement letter, constitute the entire agreement between the parties relating to the subject matter and supersede any prior discussions or representations.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force.

Waiver

Failure by either party to enforce any right under these Terms shall not constitute a waiver of that right.

Assignment

The client may not assign or transfer their rights or obligations under these Terms without Santi Counsel's prior written consent. Santi Counsel may assign its obligations to a suitably qualified successor.

Notices

Formal notices should be sent by email to [email protected] or by post to our registered address. Notices are effective upon confirmed receipt.

SECTION 15

Changes to Terms

Santi Counsel may update these Terms from time to time to reflect changes in services, applicable law, or operational requirements. Where changes are material, we will update the "Last Updated" date at the top of this page and, where appropriate, notify active clients directly.

Continued use of our website or services after changes have been published constitutes acceptance of the revised Terms. We encourage you to review this page periodically.
